Terms of Service

These Terms of Service ("Terms") govern your use of the RideGuard mobile application and related services ("RideGuard," the "Service"). By creating an account or using the Service, you agree to these Terms. If you do not agree, do not use the Service.

1. Who May Use RideGuard

  • You must be at least 18 years old to create and manage a RideGuard family as a parent or guardian.
  • A rider account may be used by a minor only if a parent or guardian sets it up, supervises it, and consents to the collection and use of the rider's information as described in our Privacy Policy.
  • By adding a rider, you confirm you are that rider's parent or legal guardian, or have that person's authority and consent to add them.

2. What RideGuard Does

RideGuard helps families stay connected by providing live location, ride history, geofence zones, alerts, and ride safety scores for riders of e-bikes, dirt bikes, and similar vehicles. Features depend on device permissions, connectivity, battery, and other factors outside our control.

3. Safety Disclaimer — Please Read Carefully

⚠️ RideGuard is an assistive tool, not a safety device or guarantee.

  • RideGuard does not prevent accidents, injuries, or unsafe riding.
  • Crash detection, stunt detection, speed alerts, and geofence alerts are best-effort estimates generated from phone sensors and GPS. They may be delayed, inaccurate, missing, or falsely triggered, and may fail entirely if a device is off, out of battery, without signal, or not mounted properly.
  • RideGuard is not an emergency service. In an emergency, contact local emergency services (e.g. 911) directly. Do not rely on RideGuard to summon help.
  • RideGuard is not a substitute for adult supervision, proper safety gear (including helmets), rider training, vehicle maintenance, or obeying local laws.
  • You are solely responsible for safe and lawful riding and for supervising any minor rider.

You use RideGuard and rely on its information at your own risk.

4. Your Account

You are responsible for keeping your login credentials secure and for all activity under your account. Notify us at support@gorideguard.com if you suspect unauthorized use. Information you provide must be accurate.

5. Acceptable Use

You agree not to:

  • Use RideGuard to track or locate any person without their knowledge and the required consent;
  • Use the Service to harass, stalk, endanger, or harm anyone;
  • Use the Service for any unlawful purpose or in violation of local riding, traffic, or privacy laws;
  • Interfere with, disrupt, reverse-engineer, or attempt to gain unauthorized access to the Service or its systems;
  • Misrepresent your identity or your authority over a rider.

We may suspend or terminate accounts that violate these Terms.

6. Location Tracking and Consent

RideGuard collects precise location, including in the background, while a ride is active. By using the Service you consent to this collection and use as described in the Privacy Policy. Riders should be informed that their location and rides are shared with their family. You are responsible for ensuring all required consents are in place.

7. Subscriptions and Payments

RideGuard is currently offered free of charge. We may introduce paid features or subscription plans in the future. If we do:

  • Pricing and what each plan includes will be shown in the app before you purchase.
  • Purchases are processed by Apple through your App Store account, and are subject to Apple's terms.
  • Paid subscriptions renew automatically at the end of each billing period unless auto-renew is turned off at least 24 hours before the period ends.
  • Except where required by law, payments are non-refundable; refund requests for App Store purchases are handled by Apple.

We will give notice within the app before any previously free feature you rely on becomes paid.

8. Intellectual Property

RideGuard and its content, branding, and software are owned by RideGuard and its licensors and are protected by law. We grant you a limited, personal, non-transferable, revocable license to use the app for its intended purpose. You may not copy, modify, distribute, or create derivative works except as allowed by law.

9. Third-Party Services

RideGuard relies on third-party services (including Google Firebase and Supabase) and on your device, carrier, and operating system. We are not responsible for the availability, accuracy, or conduct of third parties.

10. Disclaimers

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, ACCURACY, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR THAT ALERTS OR DETECTIONS WILL BE TIMELY OR ACCURATE.

11. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, RIDEGUARD AND ITS OWNERS, EMPLOYEES, AND SUPPLIERS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR FOR ANY LOSS ARISING FROM ACCIDENTS, INJURIES, DEATH, PROPERTY DAMAGE, OR FAILURE OF ANY ALERT OR DETECTION FEATURE. OUR TOTAL LIABILITY FOR ANY CLAIM RELATING TO THE SERVICE WILL NOT EXCEED THE GREATER OF US$100 OR THE AMOUNT YOU PAID US IN THE 12 MONTHS BEFORE THE CLAIM.

Some jurisdictions do not allow certain limitations, so some of the above may not apply to you.

12. Indemnification

You agree to indemnify and hold RideGuard harmless from claims and expenses arising out of your use of the Service, your violation of these Terms, or your violation of any law or the rights of another person.

13. Termination

You may stop using RideGuard and delete your account at any time in Settings. We may suspend or terminate access if you violate these Terms or to protect the Service or its users.

14. Changes to These Terms

We may update these Terms from time to time. We will update the "Last Updated" date and, for material changes, provide notice within the app. Continued use after changes take effect constitutes acceptance.

15. Governing Law and Dispute Resolution

These Terms are governed by the laws of the State of Texas, United States, without regard to its conflict-of-laws rules.

Informal resolution first. Before filing any claim, you agree to contact us at support@gorideguard.com and attempt to resolve the dispute informally for at least 30 days.

Binding arbitration. If a dispute is not resolved informally, you and RideGuard agree that it will be settled by binding individual arbitration administered by a recognized arbitration provider, rather than in court, except that either party may bring an individual claim in small-claims court.

Class-action waiver. Disputes will be resolved only on an individual basis. You and RideGuard waive any right to bring or participate in a class, collective, or representative action.

Exceptions and your rights. Nothing in this section limits rights that cannot be waived under applicable law. Some jurisdictions do not permit mandatory arbitration or class-action waivers; where that is the case, this section applies only to the extent permitted, and disputes will otherwise be resolved in the state or federal courts located in Texas.
